FitBark Inc. (“us”, “we”, or “our”) designs products that monitor pet health & lifestyle (the “Devices”), operates (individually the “Website” and collectively with its sub-domains, the “Websites”), the FitBark mobile applications (each an “App” and collectively the “Apps”) and the FitBark API (the “API”). The Devices, Websites, Apps and API are collectively referred to as the FitBark “Service” or FitBark “Platform”.

This page informs you of our policies regarding the collection, use and disclosure of personally identifiable information (“Personal Information”) when you use our Service. This policy does not apply to the practices of companies that FitBark does not own or control (including any third party products or services used for logging into our Websites, or that are integrated with our Service).

We will not use or share your information with anyone except as described in this Privacy Policy.

We use your Personal Information for providing and improving the Service. By using the Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Use.

Information Collection

While using our Service, we ask you to provide us with certain Personal Information that may be used to contact or identify you. Personal information may include, but is not limited to, your name, your email address, your postal address, your date of birth, your profile pictures, your phone number, your payment information (which we don’t store on our servers), your IP address, your language, your dog’s profile, your dog’s health, location and behavioral information, and other information we may collect or request from time to time (collectively referred to as “Personal Information”). Personal Information may be collected, without limitation, when you activate or synchronize a Device, when you create an Account, when you add information to your Account, when you visit our Websites, when you purchase from our Websites, when you sign up for our newsletters, when you join our affiliate, referral or developer programs, when you participate in a sweepstake, contest or promotion, when you share any materials for publication on social media, when you invite other users, when you contact us for support, and when you activate location features.

We may receive Personal Information about you from other sources (for example when you register for the Service via Facebook social login, when you link your human fitness tracker, when you take online surveys, or through service providers who enhance our marketing data). We may also obtain Personal Information about you from other companies related to our brands. In each of these cases we may add this information to the Personal Information we have already collected from you in order to improve the Service.

We may collect information such as your name, email, mailing address, date of birth, profile pictures, phone number, payment information, IP address, location, language, and health data via Fitbit, Apple HealthKit, Google Fit or other providers. Most importantly, we may collect your doggie’s profile as well as his or her health, location and behavioral information.

Use of Personal Information

We collect this information for the purpose of providing the Service to you in the best possible way, identifying and communicating with you, responding to your requests/inquiries, making product recommendations, servicing your purchase orders, sending you system alert messages, enforcing compliance of our Terms of Use and applicable law, protecting the rights and safety of other users and third parties (as well as our own), meeting legal requirements, providing information to our representatives and advisors, prosecuting and defending a court, arbitration or similar legal proceedings, responding to lawful requests by public authorities, and improving the Service. We may also use anonymized data (that does not identify you or your dog) to inform the community about health trends, for our data analytics projects, for marketing and promotional use, or for sale to third parties.

We use your data to make FitBark useful, talk to you, sell you stuff, and meet legal requirements. We also aggregate data anonymously to improve the life of dogs everywhere.

Log Data

We collect information that your browser sends whenever you visit our Service (“Log Data”). Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages and other statistics.

In addition, we may use third party services such as Google Analytics that collect, monitor and analyze this type of information in order to increase our Service’s functionality. These third party service providers have their own privacy policies addressing how they use such information.

When you access the Service by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device’s unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, your location information and other statistics.

Our servers also collect log information that we use to provide you with a better service.

Location information

We may use and store information about your location depending on the permissions you have set on your device. We use this information to provide features of our Service, and to improve and customize our Service. Depending on the most current requirements of your mobile operating system provider, you may enable or disable location services when you use our Service at anytime, through your mobile device settings.

We may collect your phone’s location for the purpose of collecting statistical information about FitBark dogs, or to help conserve battery life on our location-enabled FitBark devices.


Cookies are files with a small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and transferred to your device. We use cookies to collect information in order to improve our Service for you.

You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. The Help feature on most browsers provide information on how to accept cookies, disable cookies or to notify you when receiving a new cookie.

If you do not accept cookies, you may not be able to use certain features of our Service. We recommend that you leave them turned on.

Behavioral Remarketing

FitBark Inc. uses remarketing services to advertise on third party web sites to you after you visited our Service. We, and our third party vendors, use cookies to inform, optimize and serve ads based on your past visits to our Service.

Facebook. Through the use of the Facebook Pixel integrated on certain pages of our website, we are able to measure the effectiveness of our Facebook and Instagram marketing campaigns (conversion tracking) and to create custom audiences of users who have visited our website. We may use those custom audiences to improve the targeting of our Facebook and Instagram campaigns. The Pixel is sending “Event Data” to Facebook to permit Facebook to track – on our behalf – the way visitors use our website.

Service Providers

We may employ third party companies and individuals to facilitate our Service, to provide the Service on our behalf, to perform Service-related services and/or to assist us in analyzing how our Service is used.

These third parties have access to your Personal Information only to perform specific tasks on our behalf and are obligated not to disclose or use your information for any other purpose.

We can’t do this alone. But when a third party helps us, your Personal Information is safe.


We may use your Personal Information to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.

From time to time, we may send you emails based on your profile settings.

Compliance With Laws

We will disclose your Personal Information where required to do so by law or subpoena or if we believe that such action is necessary to comply with the law and the reasonable requests of law enforcement or to protect the security or integrity of our Service.

We’ll have to let the police snoop on your Personal Information if they say so.

Business Transaction

If FitBark Inc. is involved in a merger, acquisition or asset sale, your Personal Information may be transferred as a business asset to a new company. In such cases, we will provide notice before your Personal Information is transferred and/or becomes subject to a different Privacy Policy.

If FitBark is acquired or merges with another company, that company may have access to your personal information.


The security of your Personal Information is important to us, and we strive to implement and maintain reasonable, commercially acceptable security procedures and practices appropriate to the nature of the information we store, in order to protect it from unauthorized access, destruction, use, modification, or disclosure.

We do our best to keep your personal information safe, but nothing is 100% secure.

We have no control over, and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

Children’s Privacy

Only persons age 13 or older have permission to access our Service. Our Service does not address anyone under the age of 13 (“Children”). We recommend that minors between the ages of 13 and 18 ask and receive their parents’ permission before using the Service or sending information about themselves or anyone else over the Internet.

We do not knowingly collect personally identifiable information from children under 13. If you are a parent or guardian and you learn that your Children have provided us with Personal Information, please contact us. If we become aware that we have collected Personal Information from a child under age 13 without verification of parental consent, we take steps to remove that information from our servers.

You may not use FitBark is you’re below 13 years of age. If you’re between 13 and 18, read this document with your parents.

Your Rights

To exercise any of the following rights, please contact us at (i) Revocation of consent. You may revoke the consent for future processing of Personal Information at any time. However, this does not affect the lawfulness of Personal Information processing based on the consent before the revocation. (ii) Right of access. You have the right to obtain confirmation as to whether or not your Personal Information is being processed by us and, if so, a more specific details on what Personal Information is being processed. (iii) Right to rectification. You have the right to obtain from us the rectification of inaccurate Personal Information concerning you. In case the information processed by us is not correct, we will rectify this information without undue delay and inform you of this rectification. (iv) Right to erasure. Should you decide you do not want us to process your Personal Information any further, please contact us. We’ll delete your account and erase your data. Should mandatory provisions of law prevent such erasure, we will inform you. (v) Right to data portability. You have the right to object at any time to the processing of Personal Information for which our legitimate interests are the legal basis, including profiling based on those provisions.
